1. Agreement
These Terms of Service ("Terms") are an agreement between you and Pocketgale ("Pocketgale", "we", "us") for the mobile games we publish, including Island Escape (each a "Game"), and the website pocketgale.com (together, the "Services"). By downloading, installing or playing a Game, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
The terms of the app store you downloaded a Game from (for example Google Play) also apply. If they conflict with these Terms on the relationship between you and the store, the store's terms win.
2. Who can play
Our Games are made for a general audience and are not directed at children under 13. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian, who accepts these Terms for you.
3. Your licence
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Games on devices you own or control, for your own non-commercial entertainment. All rights not expressly given to you are reserved by us and our licensors.
4. Fair play
When using the Services, you agree not to:
- copy, modify, decompile, reverse engineer or create derivative works of a Game, except where the law allows it regardless of this restriction;
- use cheats, hacks, bots or modified versions of a Game, or interfere with how a Game or its ads work, including fake or automated ad views or clicks;
- sell, rent, sublicense or redistribute a Game or its content, or use it commercially without our written permission;
- remove or hide copyright, trademark or other notices; or
- use the Services in any unlawful way.
You are welcome to share screenshots and videos of yourself playing our Games, including on monetised channels, as long as you do not suggest we endorse you and do not use our content in a misleading or offensive way.
5. Virtual items
Games may include virtual items such as gold, stars, hints, extra moves or collectibles ("Virtual Items"). Virtual Items are part of your licence to play: they have no monetary value, cannot be exchanged for real money, goods or services, and cannot be sold or transferred. Because your progress and Virtual Items are stored only on your device, they may be lost if you uninstall the Game, clear its data or change devices, and we cannot restore them. We may change how Virtual Items work, for example to rebalance a Game.
6. Ads
Our Games are free and supported by ads, shown by third-party ad networks as described in our Privacy Policy. Some ads are optional videos that give an in-game reward when watched to the end. A reward depends on an ad being available and fully watched; if an ad fails to load or is closed early, the reward may not be given. We are not responsible for the content of third-party ads or the products they promote, but we limit our ads to family-friendly content and will block ads you report to us.
7. Purchases
Our Games currently offer no in-app purchases. If a Game offers them in the future, payments will be processed by the app store under its terms, and refunds will be handled under the app store's refund policy and the consumer law that applies to you.
8. Ownership
The Games, this website and everything in them (code, art, characters, levels, music, sounds, text, names and logos) are owned by us or our licensors and are protected by copyright, trademark and other laws. "Pocketgale", "Island Escape" and our logos are our trademarks. Third-party fonts and libraries are used under their own licences.
9. Feedback
We love hearing your ideas. If you send us suggestions or feedback, you allow us to use them to improve our Games without any obligation to you.
10. Third-party services
The Services rely on third-party services, such as app stores, Google AdMob and Unity Ads, which have their own terms and privacy policies. We are not responsible for third-party services or for websites linked from ads or from our Services.
11. Updates and availability
We may update, change or stop offering a Game or any part of it at any time, for example to add levels, fix bugs or meet store requirements. Some updates may be needed to keep playing. We do not promise that the Services will always be available, uninterrupted or error-free.
12. Ending these terms
You can stop using the Services at any time by uninstalling the Games. We may end or suspend your licence if you seriously or repeatedly break these Terms. Sections 5, 8, 13, 14, 15 and 16 continue after these Terms end.
13. Disclaimer
Our Games are provided for entertainment. To the extent the law allows, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract under the law where you live.
14. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, progress, Virtual Items or profits, arising from your use of the Services. Our total liability for any claim related to the Services is limited to the greater of the amount you paid us for the Service concerned in the 12 months before the claim, or USD 50. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded by law.
15. Governing law and disputes
These Terms are governed by the laws of the country in which Pocketgale is established, without regard to its conflict-of-law rules. Disputes will be handled by the courts of that country. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts. Before starting any formal dispute, please email us: most problems can be solved quickly and informally.
16. General
- Changes to these Terms: we may update these Terms, for example when we add features. We will post the new version here with a new effective date, and significant changes will be mentioned in the Game's update notes. If you keep playing after the change, the new Terms apply.
- Whole agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the Services.
- Severability: if part of these Terms is found unenforceable, the rest stays in effect.
- No waiver: if we do not enforce part of these Terms, we can still enforce it later.
- Transfer: we may transfer these Terms to a company that takes over a Game or our business. You may not transfer your rights under them.
